City Of Laramie News Notice Of Consideration Of Amendments To The Albany County Platting And Subdivision Resolution

The Board of County Commissioners of Albany County, WY (Board) hereby gives notice of its intent to adopt amendments to the Albany County Platting & Subdivision Resolution (Subdivision Resolution), in its entirety but particularly for Chapters 1–5, following public hearing on the amendments at the Board’s regularly scheduled meeting on March 7, 2023, at 9:30 a.m. in the Commissioners’ Chambers, 1st floor of the Albany County Courthouse, 525 Grand Ave, Room 105, Laramie, WY 82070 and via Zoom. The public hearing may also be viewed on the Albany County Government YouTube channel.

The proposed amendments to the Subdivision Resolution:

Revise formatting and styling, and change chapter and page numbers from Latin to Arabic numerals throughout the entire Subdivision Resolution;

Refine language and organization for clarity and consistency;

Update provisions to match statutory changes in W.S. §§ 18-5-301–318 & 34-12-101–115;

Provide new and revised definitions applicable to the Subdivision Resolution;

Amend procedures and provisions for the review of subdivision permit applications by the Planning & Zoning Commission and Board;

Provide a process for separate review of preliminary plats/reports and final plats/subdivision permit applications for major subdivisions creating 3+ parcels that are less than 35 acres each;

Provide and amend standards and requirements for applications for various types of subdivisions;

The principal reason for the adoption of the proposed amendments is to allow the Planning & Zoning Commission and Board to review subdivision proposals more comprehensively and meaningfully by amending the procedures and standards for subdivision permit applications, particularly the separate review for major subdivisions, and amending the information required from applicants. The proposed amendments also provide necessary updating of statutory language and generally improve organization and language.

The proposed amendments generally meet the minimum substantive statutory requirements of county real estate subdivision regulatory authority, W.S. §§ 18-5-301–318, and county platting and dedication authority, W.S. §§ 34-12-101–115; except that the proposed amendments introduce more stringent review procedures and application standards and requirements than those of W.S. §§ 18-5-301–318. The procedures, standards, and requirements which exceed the minimum substantive statutory requirements are permitted by W.S. § 18-5-315 and are proposed to enable more thorough review of subdivision proposals and their potential impacts.

Interested persons may present their data, views, or arguments at the public hearing and in writing to the Albany County Planning Office or directly to the Board through the County’s website at https://www.co.albany.wy.us/formcenter/Contact-Us-Forms-6/Commissioners-53. All comments received prior to or at the public hearing will be part of the public record for the proposed amendments.
